Welcome to Druzari.com. These Terms and Conditions ("Terms") govern your access to and use of the Druzari website (the "Site"), and the purchase of any products ("Products") from Druzari ("we," "us," or "our"). By accessing the Site or purchasing Products, you agree to be bound by these Terms and our Privacy Policy.
1. Use of the Site
You agree to use the Site for lawful purposes only. You are granted a non-exclusive, non-transferable, revocable license to access and use the Site strictly in accordance with these Terms. As a condition of your use of the Site, you warrant to Druzari that you will not use the Site for any purpose that is unlawful or prohibited by these Terms. You may not use the Site in any manner which could damage, disable, overburden, or impair the Site or interfere with any other party's use and enjoyment of the Site.
All content included as part of the Service, such as text, graphics, logos, images, as well as the compilation thereof, and any software used on the Site, is the property of Druzari or its suppliers and protected by copyright and other laws that protect intellectual property and proprietary rights. You agree to observe and abide by all copyright and other proprietary notices.
2. Product Information and Sales
We strive to ensure that all details, descriptions, and prices of Products appearing on the Site are accurate. However, errors may occur. If we discover an error in the price of any Products which you have ordered, we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it.
2.1. Natural Variation of Wood
Our products are made from natural solid wood. As such, variations in color, grain, texture, and character are inherent and are not considered defects. The images on our Site are representative, but we cannot guarantee that the piece you receive will be an exact match to the one shown. These natural variations are part of the unique beauty of each handcrafted item.
2.2. Bespoke Commissions
For all custom or bespoke orders, we require a non-refundable 50% deposit to begin the design and crafting process. The remaining balance is due prior to shipping. We will work with you through a detailed design approval process, including renderings and material samples. Once the design is approved and production begins, changes may not be possible or may incur additional costs. Lead times for bespoke commissions are estimates and can vary.
2.3. Payment
By providing a credit card or other payment method, you represent and warrant that you are authorized to use the designated payment method and that you authorize us (or our third-party payment processor) to charge your payment method for the total amount of your order (including any applicable taxes and other charges).
3. Shipping and Delivery
We ship our Products within the continental United States. Shipping costs and methods are determined at the time of purchase. For larger items, we use specialized freight carriers. It is your responsibility to ensure that the furniture will fit through all access points (doorways, stairs, elevators, etc.) to its final destination. Shipping fees are non-refundable if a delivery is unsuccessful due to access limitations.
Upon delivery, you or a designated representative must inspect the Product for any damage that may have occurred in transit. You must note any damage on the carrier's bill of lading before signing. Failure to do so may prevent us from filing a claim with the carrier and may limit our ability to remedy the situation. You must report any damage to us within 48 hours of delivery.
4. Returns, Refunds, and Cancellations
Due to the custom, made-to-order nature of our work, we do not accept returns or offer refunds on any Products, except in the case of significant manufacturing defects or damage in transit that was properly documented upon receipt.
Cancellations for standard collection items are accepted only within 48 hours of placing the order. For bespoke commissions, the 50% deposit is non-refundable, and once production has commenced, the order cannot be cancelled.
5. Limitation of Liability
To the fullest extent permitted by applicable law, Druzari shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the site; (b) any conduct or content of any third party on the site; (c) any content obtained from the site; and (d) unauthorized access, use, or alteration of your transmissions or content.
In no event shall Druzari's aggregate liability for all claims related to the products exceed the total amount paid by you to Druzari for the product in question.
6. Indemnification
You agree to indemnify, defend, and hold harmless Druzari, its officers, directors, employees, agents, and third parties, for any losses, costs, liabilities, and expenses (including reasonable attorney's fees) relating to or arising out of your use of or inability to use the Site or services, any user postings made by you, your violation of any terms of this Agreement or your violation of any rights of a third party, or your violation of any applicable laws, rules or regulations.
7. Disclaimer of Warranties
Except as expressly provided in writing by Druzari, the Site and the Products purchased are provided on an "as is" basis without warranties of any kind, either express or implied. Druzari disclaims all other warranties, express or implied, including, without limitation, implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do warrant that our Products will be free from major structural defects in material and workmanship for a period of one (1) year from the date of delivery. This warranty does not cover issues resulting from normal wear and tear, misuse, improper care, or environmental factors (e.g., extreme humidity changes).
8. Governing Law and Jurisdiction
These Terms and your use of the Site shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law principles. You agree to submit to the personal and exclusive jurisdiction of the state and federal courts located in Buncombe County, North Carolina.
9. Changes to Terms
Druzari reserves the right, in its sole discretion, to change the Terms under which druzari.com is offered. The most current version of the Terms will supersede all previous versions. We encourage you to periodically review the Terms to stay informed of our updates.
